Hermanas y hermanos, amig@s y compañer@s. Esperando que gocen de muy buena salud

Compañer@s del primer Encuentro Internacional Anticarcelario Septiembre Negro.

El día 5 de septiembre aproximadamente a las nueve treinta de la noche, se abren ante mí las puertas de la venganza del sistema y vuelvo a pisar la calle, después de siete años tres meses y 21 días, gracias al trabajo de l@s compañer@s que hacen posible que las puertas se nos abran a much@s ex-pres@s.

La solidaridad de tod@s ustedes y el activismo realizado, ya sea con la difusión de los casos, por medio revistas, fanzines y conciertos nos hace saber que no estam@s sol@s y que desde la trinchera de cada un@ de ustedes contribuye con el granito de arena, hacen que se llenen los corazones de l@s que están y estábamos allá dentro, el trabajo que se realiza desde afuera nos hace muy fuertes, una carta para alguien ahí es algo muy alentador.

El sistema quiere controlarnos, apaciguarnos, domesticarnos y su “readaptación” es la sumisión a su sistema nefasto, aun ahí podemos ser libres, podemos soñar, la peor cárcel no es la física, la peor cárcel es la que se lleva en la mente y en le corazón, la lucha se hace a diario desde cualquier lugar y estas jornadas nos alientan a seguir luchando por l@s nuestr@s, por nuestr@s pres@s, tanto políticos como comunes, la cárcel no sirve, luchamos por la abolición del sistema penitenciario y la disolución social al código penal.

Un abrazo enorme a tod@s ustedes que hacen que los sueños interrumpidos sigan adelante y que ya no sean una pesadilla.

Que nuestros sueños de libertad sean una pesadilla para los burgueses y tiranos.

INFORME SOBRE LA SITUACIÓN JURIDICA DEL COMPAÑERO ANARQUISTA CARLOS ALBERTO ESTRADA “EL SKIN”
(Julio del 2008)

Saludos y reciban un fuerte abrazo.

Antes que nada quisiera pedir una disculpa por la tardanza de esta información, sobre todo para aquellos y aquellas compañeras que han estado al tanto de lo que acontece sobre la situación del compañero preso.

Los motivos se reducen a que no se tenía nada claro sobre como estaba avanzando la solicitud de la prelibertad, sumándosele el laberinto burocrático que siempre esta presente en estas situaciones.

Durante el mes de mayo se continuo con la visita a Carlos, no solamente ya por su familia y gente que estamos cerca de su caso, sino que se facilito que más compañeros entraran a verle como es el caso de compañeros de la CNA del DF, gente de la Biblioteca Social Reconstruir y algunos compañeros internacionales. Esto ayudo a que el compañero Carlos tuviera contacto con más gente y ayudaran a dispersar el pensamiento mas allá de estos muros, pero sobre todo ver a compañeros que desde hace largo tiempo no veía.

En el mes de junio se estuvo a la espera de que la solicitud de prelibertad pasará a consejo. Pensando que a mediados de este se revisaría la petición, pero lamentablemente fueron rechazadas las dos ofertas de trabajo que se presentaron, una era de vendedor de periódicos y otra en un taller de serigrafía, diciéndonos que no cumplían con los requisitos, los argumentos fueron: para la primera oferta de trabajo, que no estaba dentro de los horarios de supervisión de la trabajadora social, ya que el horario del trabajo sería de 6 de la mañana a 12 del día y comúnmente la supervisión es por las tardes, además que al estar vendiendo en la calle no existía un lugar fijo para dicha supervisión, sobre la otra oferta en el taller de serigrafía nos dijeron que no cubría un horario de aproximadamente 48 horas a la semana y que el contacto con solventes podría facilitar el consumo de estos (ya que cuando le hicieron el estudio sobre personalidad a Carlos en el 2001 el admitió haber consumido drogas en alguna etapa de su vida, pero que ya no lo hacia desde hace años), por lo cual bajo este argumento se cancela la prelibertad y se considera que hasta que no exista una oferta de trabajo que cumpla con los requisitos que solicita la institución penitenciaria se reconsideraría otorgar este beneficio, por lo cual revisarían de nuevo su caso en el consejo hasta el mes de diciembre. Toda esta noticia nos vino a desanimar ya que consideramos que por ciertos requisitos fue negado este beneficio y no encontrábamos argumentos claros para tal negativa.

Por lo tanto durante el mes de julio la idea era entrevistarse con la trabajadora social para poder llegar a dos acuerdos que serian importantes. Uno que se diera tiempo suficiente para conseguir una nueva oferta de trabajo que cumpliera con los requisitos que nos piden, (cubrir un horario de 48 horas, un trabajo estable y alejado del contacto con sustancias volátiles) y el segundo que no se pasara el caso hasta diciembre sino que se volviera avalorar en el próximo consejo extraordinario. Esto era muy importante ya que por ciertos requisitos no queremos esperar más tiempo. Además que al parecer solo la oferta de trabajo fue el motivo para rechazar el beneficio de la prelibertad, sin tomar en cuenta que más del 95% ya estaba cubierto y aceptado por las diferentes áreas.

Por lo cual la entrevista se llevo a cabo la semana pasada con muy buenos resultados. En primer lugar se argumento que en el estado de Jalisco, es muy difícil conseguir trabajo (como en muchas partes) a personas que salen de las cárceles, además que en Guadalajara muchas de las veces se le pide a la persona que quiere trabajar un escrito que le llaman “carta de policía”, que es un documento que extiende en las oficinas del ayuntamiento para corroborar que no existen antecedentes penales o que no hayan participado en actos delictivos. Durante este tiempo se buscaron varios trabajos, pero ninguno pudo cumplir con tales requisitos, quedando solo la del taller de serigrafía. Y fue esta la que se presento junto con el argumento del porque no teníamos otras opciones y que el compañero solo realizaría tareas sencillas que nada tenían que ver con el manejo de solventes. Después de algunas pláticas fue aceptada y se consiguió que se revisara la petición de prelibertad en la próxima junta extraordinaria que se llevará acabo a finales de julio.

Lo que sigue es la visita de la trabajadora social al lugar donde se le daría alojamiento a Carlos si sale en libertad, verificar el lugar donde trabajaría y entrevistarse con las autoridades de la Secretaria de Seguridad Pública y Readaptación Social del Estado de Jalisco (SSPRS) para que tengan conocimiento y estén de acuerdo que el compañero realice las firmas correspondientes en las oficinas que ellos autoricen en Guadalajara. Después de esta visita que se daría en las próximas semanas tendríamos que esperar, a que el consejo técnico sesione y presente el resultado de la visita de la trabajadora social junto con la oferta de trabajo, para solicitar de nuevo la petición de prelibertad, para que se valore y ver si ya no existen impedimentos para que se le otorgue este beneficio. En caso de ser positiva la respuesta, el expediente y el resultado pasarían al juzgado segundo, donde el juez ejecutor ratificaría dicha solicitud y se reenviaría a la sala del tribunal en el estado de Toluca donde se confirmaría dicha solicitud y se giraría la orden de prelibertad para el compañero, calculamos que para mediados de agosto se nos tendrá una respuesta. En caso de ser negado el beneficio se solicitaría un plazo para cubrir los requisitos y que nuevamente se analice la petición en el próximo consejo técnico.

Durante estos meses nos hemos encontrado con un aparato burocrático absurdo que utiliza argumentos muy vagos y arbitrarios obstruyendo la pronta salida del compañero, el cual esta en tiempos de tener este beneficio. Pero también hemos reafirmado con esta experiencia, que no existe tal rehabilitación dentro de estos centros de aislamiento, ya que se supone que dentro de estos lugares existen programas de desintoxicación y platicas sobre el uso de drogas, a los cuales tienen que asistir forzosamente los internos, junto con las entrevistas que tienen que tener periódicamente con el psicólogo y la trabajadora social, supuestamente su trabajo debería de ser el ayudar y facilitar la reincorporación a la sociedad de los presos, pero son ellos mismo los que dudan del resultado de dichos programas de rehabilitación que aplican.

Aunque estamos muy entusiasmados por estos acuerdos, sabemos que hasta no encontrarse el compañero fuera de este lugar no cesara nuestra lucha y esperamos que ya no existan más barreras que lo impidan para pronto verle fuera de esos muros de represión.

Para terminar les hago llegar los saludos del compañero, el cual agradece su solidaridad, sus cartas y amistad en estos mas de siete largos años de cautiverio.

NEWSLETTER ABOUT THE JUDICIAL SITUATION OF OUR ANARCHIST FRIEND CARLOS ALBERTO ESTRADA “EL SKIN”

Before anything I would like to apologize for the delay in sending this information, specially to those that have been aware of the situation of our mate in jail.

The reason of this delay is that we didn’t have that much information about the petition made to free Carlos.

During this month we had the opportunity to keep visiting Carlos, and not only us and his family but a lot of our mates had the opportunity to be with him such as a person from the CAN DF and people from the Social Library “Recostruir” and some international friends. This helped Carlos to have contact with more persons and helped him to send his thoughts beyond the walls but, above all, seeing his companions that he had not seen for a long time was very rewarding.

In June we waited for the freedom application to be sent to the Congress hoping that in the same month the application would be approved, unfortunately both of the job offers were rejected arguing that they didn’t feel the requirements, one was as a newspaper dealer and the other at a silk screening shop, the arguments to reject the offers, for the first job, was that the schedule wasn’t in hours that the social service worker could supervise Carlos because the job schedules were from 6 am to 12 pm and the supervision is during noon hours and also that as a dealer his work place would be the streets and for the second job they said it didn’t apply cause Carlos will be working with substances that could represent a temptation for him, under these arguments the freedom petition was rejected and they established that this petition wasn’t going to be considered until there is a job offer that applies to all the requirements and that they will be checking this matter until next December, news that make us feel a little disappointed as we considered that due certain requirements this benefit was denied and we could not find clear arguments for such a refusal.

So we decided to interview the social services worker during the month of July with the idea of getting two agreements, first they need to give us enough time to get a new job offer that applies to all the requirements (a schedule for 48 hours, a steady job free of contact with volatile substances), second that they consider reviewing this because on the next extraordinary council and not until December which is very important for us cause we don’t want to waste any more time considering that the job offer was the only reason to deny the petition as 95% of the freedom application is already covered and accepted for the different government organisms.

The interview had place last week with excellent results, in this interview we statedthat is really difficult to find a job in Jalisco, as many other places in Mexico, and also that when you apply for a job most of the times they ask for a “police letter” a document extended by the Guadalajara City Hall that states that the person does not have any police record, taking that as a fact we weren’t able to find another job offer that is why we insisted in the silk screening job to be considered as a good option. And that our mate would only perform simple tasks that would not involve any handling of solvents. After a few more interviews they finally accepted this offer and they also agreed to review the freedom petition in the next extraordinary meeting that is taking place the last days of July.

The next step is that the social service worker visit the place where our friend Carlos would be living in case they approve the freedom application and also the place where he will be working and a final interview with the Public Security and Readaptation Secretary of the State of Jalisco, here in Guadalajara, to notified that Carlos needs to go there every other day to sign the needed reports, after this visit we need to wait until the social services worker present the results and the job offer to be approved and be able to request the freedom of our friend Carlos in case they accept the petition. If this case receives a positive answer, the file and the corresponding results would be sent to Juzgado Segundo where the executive judge would ratify the request which would be sent to the court in the State of Toluca where the application would be confirmed and an order of pre-freedom for Carlos. Would be issued we believe that by the middle of August we would receive an answer. If they deny the petition we are going to ask for a period of time to complete the different requirements and ask them to analyze the application one more time.

During all these process we find a very burocratic system that gives us all kind of absurd arguments to deny the liberation of Carlos, we also find that the social services workers are the first ones in doubting that the exconvicts have the ability of living in our society again even when they are the ones that should be supporting them during this whole process.

Even when we are very excited about the agreements that we obtain with the social services worker we are aware that this fight will not stop until we see our dear friend Carlos out of jail and we are hoping that there will not be any more barriers between Carlos and his freedom.

Domingo 24 de Febrero del 2008.
Este día pase a visitar a Carlos al reclusorio como parte de los requisitos que nos pidió la trabajadora social para lograr su prelibertad en los próximos meses. Después de esperar algunas horas para poder ingresar, y después de tener que dar algo de dinero me permitieron el acceso a las instalaciones (ya que no cuento con la credencial de visita), posteriormente comencé a sortear las diferentes revisiones y mordidas que siempre en este reclusorio le piden a la visita; llegando al área de patios pido una estafeta (la persona encargada de buscar a los internos) que busque a Carlos en su dormitorio.
Durante el tiempo que tardo Carlos en llegar, pude observar un área dividida por una cerca de alambre de aproximadamente 2 metros custodiada por algunos internos que pedían dinero a una pareja a cambio de permitir el ingreso a este lugar, me acerque y le pregunte a uno de ellos que era exactamente ese lugar, me contesto que estaba acondicionado para las visitas conjúgales y que ellos cobraban para sostenerse dentro del reclusorio, claro dándole un porcentaje a los custodios, lo único que les dije fue que era triste que ahora ellos estuvieran actuando como carceleros hacia sus propios compañeros, lo cual los hacia parte de la corrupción que todos los fines de semana tienen que sufrir muchas personas para poder visitar a sus familiares presos, a lo que no me dijeron nada solo se voltearon y continuaron en lo que estaban.
Al poco rato llego Carlos vestido con una camisa de mezclilla y short de color azul que normalmente utilizan aquellos presos que tiene poco de ingresar y todavía no son sentenciados, y antes de preguntarle algo me contesta con una sonrisa en su rostro –pues es para cambiar de ambiente- y nos reímos mientras me daba un abrazo.
Caminamos entre los pasillos del patio para ir a buscar una cabaña, que es como una tienda de campaña acondicionada con cobijas viejas para las visitas, mientras me comentaba que estaba terminando de hacerle un tatuaje a un compañero de celda para tener un poco de ingresos. Empezamos a comer mientras le comentaba lo que estaba ocurriendo fuera de esos muros, para después platicar de los viejos recuerdos que no deben de faltar en cada visita.
Ya casi al termino de la visita nos adentramos en los últimos acontecimientos jurídicos respecto a su prelibertad y planteamos cuales podrían ser las posibles preguntas que nos realizarían un día después la trabajadora social, ya que a mediados de febrero dejo de ser su trabajadora social Karla Malagon para tomar el caso Zoila Ramírez.

Ya casi eran las 5:30 cuando los custodios nos dicen que termino la hora de visita y que me tendría que retirar, Carlos solo me dice que le salude a la banda, para después despedirnos.

Lunes 25 de Febrero del 2008
A las 11:30 llegue al reclusorio debido que a las 12 era la cita con la nueva trabajadora social, para ese momento ya había muchas personas esperando, después de un rato sale una señora vestida con bata blanca, lentes y expedientes en la mano la cual grita –familiares de Estrada Arroyo- me acerco y le digo que soy yo, me saluda y me dice que la siga hasta un cubículo que esta a un costado de la puerta de ingreso, se presenta y empieza a comentarme que ahora ella se encargara de la supervisión de Carlos ya que a la anterior trabajadora social la mandaron a otro Centro Penitenciario y además, quería ponerme al tanto de la situación de la tutela y platicar conmigo sobre la oferta de trabajo.
Después de algunas preguntas me comenta que debo de llevarle algunos datos para la siguiente cita que seria a finales de marzo. Lo que me pido fue lo siguiente:
Hablar con el encargado de prelibertades del reclusorio de Puente Grande para saber si no existe ningún inconveniente de que Carlos, si lograse su prelibertad, pueda hacer sus firmas en este lugar.
Pedir el nombre del director de la penal y el número telefónico para que la trabajadora social se ponga en contacto con él.
Hacer una cita para el mes de mayo con el encargado de prelibertades para que se pueda entrevistar la trabajadora social con él.
Presentar los documentos recientes, ya que los antiguos tienen fecha del año 2006, que es cuando se propuso la primera tutela.
Si a Carlos se le otorgase la prelibertad tendría que cumplir con los siguientes requisitos:
1) Ir a firmar semanalmente a las instalaciones de algún Reclusorio o Centro de Readaptación Social durante lo que resta de la sentencia.
2) Asistir de dos o tres veces por semana a Alcohólicos Anónimos.
3) Asistir a pláticas de prevención de consumo de drogas en algún Centro de Integración Juvenil.
4) Contar con un trabajo en el cual pueda cumplir con 8 horas laborales, y que la persona que le de trabajo este consientes de que se ausentaría del trabajo para cumplir con los tres anteriores requisitos.
5) Tener un lugar donde poder vivir.
La tutela tendrá que verificar que el preliberado cumpla con las firmas periódicas y las platicas correspondientes, además de conseguir la oferta de trabajo y ofrecer un lugar donde vivir. Si existe un impedimento de fuerza mayor por la cual no pueda asistir a las firmas o platicas, la tutela tendrá que notificarlo ya que la falta a las firmas es motivo para la revocación de la prelibertad.
La trabajadora social periódicamente visitaría la tutela y al encargado en donde laborará Carlos para supervisar el comportamiento que ha guardado y si esta cumpliendo con los horarios y los días laborales.
Los acuerdos a los que llegamos con esta nueva trabajadora social fueron los siguientes:
--- La próxima cita será a finales del mes de marzo, en la cual estarán presentes tanto Carlos como sus familiares y la tutela para que todos estén al tanto de los requisitos de la prelibertad.
--- Pasará a consejo técnico el caso de Carlos para finales de mayo y principios de junio en el cual concederían o cancelarían la prelibertad (en esto perdimos un mes ya que con la trabajadora social que tenia antes habíamos acordado que seria a finales de abril o principios de mayo).
--- La tramitación de la credencial para acceso al reclusorio y que sería entregada en la próxima visita.
--- Una cita con el Director para solicitarle la revisión del expediente antes de lo acordado.
--- Dar tiempo para presentar una nueva oferta de trabajo ya que la que se había propuesto no fue aceptada por no cumplir con un horario de 8 horas al día.
Algunas cosas todavía no las sabe Carlos, ya que la visita que tendrá será el próximo domingo para comentarle todo esto.
Como verán entramos ahora de lleno dentro de la burocracia penitenciaria, la cual siempre es como un laberinto muy difícil, pero esperamos que todo salga favorable para el compañero.
Dentro de poco ya estará listo el documento en el cual se solicite la reducción de la condena, el cual se contemplo como algo paralelo dentro de la solicitud de la prelibertad.
Carlos se encuentre bien y les manda saludos a todos y todas.

Sunday 24th February 2008
I visit Carlos in prison on the 24th February as part of the requirements asked for by the social worker in order to reach Carlos preliberty in the next few months. After waiting a few hours and giving some Money, I was given permission to enter the facilities (as I don’t have a proper visit card), after passing the different revisions and bribes that are always done in this prison. When I reached the yard area I asked the person who goes to fetch the prisoners if he can go and look for Carlos to his dormitory.

When waiting for Carlos, I saw a wired area about 2 m wide guarded by two prisoners asking for money to a couple so that they both could enter this place. I approach the prisoners and asked them what was that place intended for, and he answered it was for the conjugal visits and they asked for money for their lives inside prison, giving a percentage to the guardians, of course. I told them it was a shame they were acting as the prison guardians, and they were part of the corruption many people have to suffer every weekend to visit their relatives imprisoned. They didn’t answer me, they just turned and carried on with what they were doing.

Alter a little while Carlos arrived dressed on a denim shirt and blue shorts, usually worn by the prisoners who have not been sentenced yet. Before I asked him anything, he answered me with a big smile (just to change subject), we laughed and he embraced me.

We walked through the yard aisles in search of a hut, a sort of tent with old blankets for the people visiting the prisoners, as he told me he was finishing a tattoo for a cellmate to have some cash. We started to eat and I told him what is happening outside the prison, and then about our old memories, essential in every visit.

Nearly at the end of the visit we talked about the last news regarding to his preliberty and about the questions that the social worker could ask us on the following day, as Karla Malagon had stopped being his social worker in middle February and now the case was taken by Zoila Ramírez.

It was nearly 5.30 when the guardians told us to finish the visit and I had to go. Carlos asked me to greet everyone outside, and we then say goodbye.

Monday 25th February 2008
I arrived in the prison at 11.30, because I had a meeting with the new social worker at 12.00. There were a lot of people waiting. After a while a woman on a white coat, glasses and files on her arms got out and asked for Carlos Estrada Arroyo’s relatives. I approached and told her it’s me, she greeted me and made me follow her to a room near the entrance door. She introduced herself and started telling me she was now in charge of Carlos’s supervision as the other social worker was sent to another prison. She also wanted to inform me about the guardianship and talked about the job offer.

After some questions she told me I had to bring some documents for our next appointment, at the end of March. She asked me the following:

To speak with the person in charge of the preliberties of the Puente Grande prison in order to know if there is any problem that Carlos can sign here if he gets his preliberty.

To ask the name of the prison director and his phone number so that the social worker can get in touch with him.

To make an appointment for May with the person in charge of the preliberties so that the social worker can have an interview with him.

To show the latest documents, because the former ones are dated on the year 2006, because that’s the date of the first guardianship.

If Carlos is given the preliberty, he should fulfil the following requirements:
1) Sign every week in the facilities of any prison or CE.RE.SO. for what lasts of his sentence.
2) Attend twice or three times a week meetings in AA.
3) Attend talks against drug abuse in any Youth Integration Centre.
4) Have an 8-hours-working-day job and where he can leave to fulfil the other three requirements.
5) Have a place to live.

The guardianship would have to verify that the preliberated signs periodically and attends the talks and corresponding practices, as well as get a job offer for him and a place to live. If there is any obstacle owed to any circumstances beyond their control that stops him to go to the signing or talks or practices, the guardianship should notify it, because the absence to the signing is cause for the reversal of the preliberty.

The social worker would periodically visit the guardianship and the manager of Carlos’s working place to observe his behaviour and if he is fulfilling timetables and labour days.

The agreements we made with the new social worker were as follows:
--- The next appointment would take place at the end of March; at this meeting should attend Carlos, his relatives and the guardianship, so that everyone can be aware of the preliberty requirements.
--- Carlos’s case will enter the Expert Board at the end of May or beginning of June; they will be the ones who decide the admission or dismissal of the preliberty (we lost a month, because the former social worker we arranged it was going to be at the end of April or beginning of May).
--- Proceed with the ID card to access the prison that will be delivered next week.
--- An appointment with the Director to ask for the case revision before it was agreed.
--- Give time to get a new job offer, as the one offered before was rejected because it didn’t cover 8 hours a day.

There are some of these aspects that Carlos still ignores, because next visit will take place next Sunday, and we will talk him about all this.

As you can see, we are now entering completely inside prison’s paperwork, which is always a really complicated labyrinth, but we hope everything goes in benefit for our mate.
In short the document asking for the reduction of the sentence will be ready; this document was seen as something parallel to the preliberty.

Report About The Legal Situation Of Carlos Alberto Estrada

Past December we talked about paying the bail of Carlos Alberto Estrada, 50,000 pesos, so that he could be released under some conditions (he should go from time to time to sign to prison during the rest of the sentence). That’s why it was decided to launch a campaign in order to get that money, but we regret to tell you that it was not possible, only $22,006.64 pesos were collected, thanks to lots of you. Therefore we have to be grateful to you once again for the support given.

When we realized that the total amount could not be paid, we look for an alternative, that is, the payment of a policy (the proportional part of the bail by a guarantor) of 18,000 pesos, copies of the deeds of a house and a copy of the ID card. But when we review the case we noticed that due to the crime he is accused of (“residential burglary”), he can’t apply to the payment of bail. The misunderstanding was due to the fact that they were based on the last reforms done to the crime of theft, saying that if the theft was not over 7,500 pesos he could be released on bail, taking into account that the fine imposed to the skin is 6, 050 pesos, but they didn’t notice that the kind of crime he is accused of made it impossible. It would appear that this situation was due to the fact that the governments and prison institutions decide every end of the year to “open” the possibility for some of the prisoners to get out of jail if they fulfil some requirements stated by them. As some of the steps followed for the preliberation of the skin were not fulfilled, the preliberation was rejected, so the bail option is ruled out.

Before this scenario we seek advice from some lawyers, who confirmed us what the guarantor said. Therefore some of us thought again in the solution of the preliberation and some of us to start with the proceedings of the reduction of the sentence.

REDUCTION OF THE SENTENCE
It consists on writing a document skating the contradictions failures and farces since the moment of his detention, legal procedure and sentence in order to minimize the crime and to make the judge rectify the sentence, giving the skin less years or months of prison. This process can last a few months, and the results can be either of no impact at all and the ratification of the sentence or the rectification of the sentence and reduction of the time of the sentence.

PRELIBERATION
Preliberation is equivalent to the parole, as a benefit for those prisoners who have kept good behaviour and are considered appropriate to return to society. To ask for this benefit, one has to cover certain requirements and the person who has been freed on parole has to go periodically to sign to prison for the rest of his or her sentence.
Until today we have tried that Carlos would receive this benefit, but this was not possible on a first attempt because they rejected the guardianship offers and there are two areas (social work and psychology) that hinder the process.

Knowing this, we talked with the people in charge of these two areas, and we reached the following agreements in benefit of Carlos:
1) They will review Carlos’ ask for preliberation on the next months.
2) They will accept again the guardianship proposed a year and a half ago.
3) Carlos has to fulfil the psychological and social work areas, and he has to continue going to the other four areas.
4) Carlos has to continue with his good behaviour during these months and has to avoid detentions.

The offer that has been spoken with his family and will be told to Carlos is as follows:
A) Ask a lawyer to go on with the paperwork of the reduction of the sentence and take them to the first courtroom in Naucalpan, hiring him only for that purpose.
B) Go on with the preliberation at the same time, fulfilling the requirements and commitments agreed.

It was established that they will review his case between April and May, time when the Technical Committee will assemble and review his case again. We also hope that for that date there is a verdict regarding to the REDUCTION OF THE SENTENCE.

As a final point, we would like to say that the seek of freedom for our mate Carlos has been followed by the solidarity of the libertarian movement, and also of many people outside our movement. This should be a point to think about in order to analyze our social environment and is now so broken in this ghetto.

It can be a bridge between different efforts, between individuals or associations, which have been uncovering the false justice of the government and its extermination centres.

Since the beginning of this campaign we have stressed that the important thing is to reach the freedom of our mate who was unfairly imprisoned as well as many others just for being poor, dressing or thinking different. We are kidnapped in this world so that they can justify their false laws, their morality and injustice falling like rain nowadays in some parts of our country (and in many other parts of the planet), where thy are making things really easy to the law guardians (that is police, army, public ministry, judges, paramilitary people, provokers, fascists, etc…) so that they can continue breaking elementary rights of the human beings so that they can maintain their control and submission of the rest of the population.

That’s why it’s hardly surprising that they are making changes directed to broaden the field of action of these “public servers” so that they can continue violating the society. Moreover, there is now an increase on the punishment for certain actions that are now inside the “terrorism or vandalism” description, to intimidate those who want to create something different to this chaos they offer us as the only alternative fore so many injustices.

The increase of the prison population proves the cruelty and arrogance of these imprisonments, and al this serves to businesspeople, judges, ministers, lawyers, police, etc. to create jobs directed to be controlled by the upper-classed, politicians, ecclesiastical hierarchies, businesspeople, presidents, deputies, senators, mass media, the army and all those who decide to be the spies of the “powerful”.

That’s why our fight for the freedom of Carlos is not a social pretext, but a fight for solidarity and against these institutions of power based on the kidnapping of our people, trying to create fear and subordination on the population.

Informe Sobre la Situación Jurídica de Carlos, Enero de 2008

En el pasado mes de diciembre se contempló la posibilidad de cubrir el pago de la fianza del compañero Carlos Alberto Estrada A. (el skin), la cual era de 50,000 pesos, para lograr su libertad condicional (teniendo que ir a firmar al reclusorio periódicamente por el resto de la sentencia). Por esto se decidió lanzar una campaña para reunir dicha cantidad, lamentablemente no se logró juntar, recaudándose solo $22,006.64 pesos gracias a la solidaridad de muchas compañeras y compañeros. Por lo cual reiteramos nuestro agradecimiento a todos ustedes por el apoyo brindado.

Al no poder cubrir el monto total, se busco como una alternativa, el pago de una póliza (que es el pago proporcional de la fianza por medio de una afianzadora) de 18,000 pesos, copias de las escrituras de una casa y de la credencial de elector. Pero al empezar a ver mas detalladamente el caso se pudo observar que debido a delito que injustamente se le imputa, “robo a casa habitación”, no alcanza el beneficio del pago de fianza. La confusión se debía a que se basaron en la ultimas reformas hechas a los delitos de robo donde si este no excedía los 7,500 pesos podía alcanzar la libertad pagando una fianza, tomando en cuenta que el monto de la multa para el skin es de 6,050 pesos, pero lo que no se reviso es que no es posible otorgarla por el tipo de delito del que se le acusa. Al parecer esto fue debido a que los gobiernos y las instituciones penitenciarias deciden a finales de cada año “abrir” la posibilidad de que personas salgan si han cumplido con ciertos requisitos que ellos mismos marcan. Pero al no cumplir algunos de los tramites que se siguieron para la preliberación del skin, se rechazo esta y este recurso de la fianza por lo pronto queda descartado. Al parecer esto fue debido a que los gobiernos y las instituciones penitenciarias deciden a finales de cada año “abrir” la posibilidad de que personas salgan si han cumplido con ciertos requisitos que ellos mismos marcan. Pero al no cumplir algunos de los tramites que se siguieron para la preliberación del skin, se rechazo esta y este recurso de la fianza por lo pronto queda descartado.

Ante este escenario se consulto con varios abogados, quienes nos confirmaban lo dicho por la afianzadora, planteándonos como solución la solicitud nuevamente de la prelibertad y otros la tramitación de la reducción de la condena.

REDUCCIÓN DE LA CONDENA
Consistiría en realizar un escrito donde se den argumentos de las contradicciones, errores, montajes desde el momento de su dentición, proceso jurídico y sentencia para lograr minimizar el delito y el juez rectifique la sentencia siendo esta más benévola, quitándole algunos años o meses de encarcelamiento. Este proceso puede durar varios meses con dos posibles resultados, uno que no haya tenido ningún impacto y que la sentencia se ratifica, y la otra que se rectifique la sentencia y se quiten calificativos reduciendo el tiempo de la sentencia.

LA PRELIBERTAD
La Preliberación, es la libertad condicional como beneficio ha aquellos internos que han guardado buen comportamiento y se les considera aptos para reincorporase a la sociedad. Para poder solicitar este beneficio se tienen que cumplir con ciertos requisitos.

Así mismo, el prelibertado deberá asistir periódicamente a las firmas semanales que realizara en la oficina de algún centro penitenciario, por lo que resta de La condena.

Durante este tiempo se ha buscado, que este beneficio se le conceda a Carlos, lamentablemente en un primer intento no se logro conseguir debido a que no autorizaron las propuestas de tutoría y en estos momentos hay dos áreas (trabajo social y psicología) que obstaculizan el proceso.

Por lo cual se entabló comunicación con las personas encargadas de estas áreas, llegando a los siguientes acuerdos que beneficiarían a Carlos:
1) la revisión de la solicitud de la prelibertad en los próximos meses..
2) La aceptación nuevamente de una tutela que se propuso hace año y medio.
3) Que Carlos cumpla con los requisitos de las áreas psicología y trabajo social, además de continuar asistiendo y participando en las cuatros áreas restantes.
4) Que en estos meses Carlos continué guardando buen comportamiento y no acumule detenciones.

La propuesta que se ha platicado con su familia y se le comentará a Carlos es la siguiente:
A) Solicitar a un abogado la realización del papeleo de la reducción de la condena y llevar dichos documentos a la sala primera del juzgado de Naucalpan contratándolo solamente para eso.
B) Paralelamente continuar con lo de la prelibertad, proporcionando nuevamente los requisitos y compromisos acordados.

El tiempo que se acordó para revisar de nuevo su expediente, quedo entre los meses de abril y mayo que es cuando se vuelve a reunir el consejo técnico y revisaran de nueva cuenta su caso. Paralelamente se espera que en esas fechas ya exista el veredicto con respecto a la tramitación de la REDUCCIÓN DE LA CONDENA.

El manejo del dinero ha estado a cargo de la familia de Carlos y se esta analizando la forma de cómo emplearlo, por lo cual en un próximo comunicado se dará una propuesta y el informe sobre lo recaudado.

Para finalizar, quisiéramos señalar que la búsqueda de la libertad del compañero Carlos ha despertado una solidaridad muy importante dentro del ámbito libertario, logrando interesar a otras personas fuera de nuestros núcleos. Siendo esto de gran aliento y a la vez de reflexión, para poder analizar nuestro entorno social y que tanto se ha roto este guetto que tanto nos identifica.

En el ámbito libertario pudo ser un puente de comunicación entre diferentes esfuerzo colectivo o individuales que de cierta forma vienen desnudando la falsa justicia del gobierno y sus centros de exterminio.

Desde el inicio de esta campaña se ha puesto hincapié en que nuestros esfuerzos van encaminados en lograr la libertad del compañero. A quien fuera encarcelado injustamente como ha muchas otras personas por el hecho de ser pobres, de vestir o pensar diferente a lo establecido, venimos poblando estos lugares en donde se nos secuestra para poder justificar sus falsas leyes, su moralidad y la injusticia que cae como lluvia en estos momentos en varias partes de la republica (como en muchas otras partes del planeta), en donde la facilidad que están otorgándole a los guardianes de la ley (léase, policías, militares, ministerios públicos, agentes judiciales, tránsitos, agentes especiales, policletos, policías a moto, carceleros, paramilitares, jueces, madrinas, provocadores, porros, grupos fascistas, etc.) para continuar violando los derechos elementales de los seres humanos y así poder mantener su estado de control y sometimiento al grueso de la población.

Por eso no nos extraña que actualmente se estén autorizando reformas que van encaminadas a otorgarle más campo de acción a estos “servidores” públicos para que continúen violentando a la sociedad. Aunado ha esto el aumento de las penas a ciertas conductas que ahora entran en el calificativo de terrorismo o vandalismo, para así intimidar y encasillar a aquellos que osan crear algo diferente a este caos que nos ofrecen como única alternativa, porque resistimos al despojo de algo que no es de ellos o porque no nos quedamos callados ante tanta injusticia.

Por lo tanto es de comprender que el aumento de la población carcelaria demuestra con que saña y prepotencia se ha venido encerrando a tanto individu@, sirviendo todo esto a empresarios, legisladores, abogados, jueces, policías, carceleros, etc. como generador de actividad laboral, esos que se dedican a ser los operadores de los medios de control impuestos por los de arriba, políticos, altos jerarcas de la iglesia, empresarios, presidentes, senadores, diputados, medios de (in) comunicación, altos mandos policiales y militares y aquellos que han decidido ser los alcahuetes y lamebotas de los “poderosos”.

Por eso nuestra lucha por la libertad del compañero no es un pretexto social, si no que es una lucha de solidaridad y de lucha contra estas instituciones de poder que se basan en secuestrar a nuestros compañeros y compañeras, intentando generar miedo y subordinación en la población.

Informe preliminar de la Campaña por la Libertad de Carlos Estrada Arroyo en Guadalajara

Este informe esta dirigido a lxs compañerxs y colectivos que invitamos a participar en la Campaña para dar a conocer lo que se ha recaudado hasta el momento y el deposito que se hizo; y para agradecer sinceramente a todos los que se estan solidarizando en esta iniciativa por la libertad del compañero anarquista Carlos Estrada.

La fecha límite para recaudar fondos es el 15 de diciembre, por lo que les comentamos que seguiremos recaudando dinero para lo que se necesite del proceso de prelibertad.

Sobre la represión y la necesaria solidaridad
En la actualidad se esta viviendo una escalada represiva y de criminalización contra cualquiera que luche, resiste y se organice, por lo que consideramos es indispensable la solidaridad y la organización para inhibir y contrarrestar la política represiva del Estado y la Sociedad del Poder.

Ante esta situación vemos necesario continuar trabajando en actividades e iniciativas para analizar, difundir y denunciar las políticas represivas, lo mecanismo de control y criminalización.

A nivel local impulsaremos, en un principio, iniciativas para discutir sobre la represión y las formas de solidaridad y organización para inhibir y responder, mientras que paralelamente se creara un fondo de solidaridad para presos.

Injustamente preso desde hace más de 6 años

Lugar de detención: Tultepec, Estado de México
Penal en que se encuentra: CE.RE.SO de Chiconautla, Estado de México.
Tipo de delitos imputados: Fuero común
Delitos: Robo calificado
Sentencia: 12 años y 6 meses de prisión,(con una multa de $6,000).

Violaciones a los derechos humanos cometidos en su contra.
-Tortura y tratos crueles inhumanos y degradantes.
-Detención arbitraria
-Abuso de autoridad
-Violación al derecho a un juicio justo

SITUACIÓN HASTA EL MOMENTO (Octubre del 2007) ´

Bajo el decreto 76, el cual otorga al sentenciado la posibilidad de lograr su Prelibertad por medio del pago de fianza y la liquidación de la multa fijada por el juez, siempre y cuando el interno haya guardado buena conducta y asistido a las diferentes áreas de rehabilitación dentro del reclusorio, existe un nuevo escenario en el cual el compañero pueda lograr su libertad en este mes de Diciembre.

Por lo que al conocer esto, el compañero Carlos invita en un primer momento a la gente que lo visita dentro de la penal, a que junto con su familia (ya que no cuentan con los recursos económicos) se busque la forma de poder tramitar nuevamente su prelibertad que meses anteriores le fue cancelada, por lo cual se inicia una campaña que busca dos objetivos;

1),- Dar a conocer el caso del compañero preso (historia de su detención, el proceso jurídico y los mecanismos que permitan que él logre su pronta libertad) denunciando la falsa justicia, el abuso de autoridad y el atropello a los derechos humanos, que vienen ocurriendo desde hace mucho años en México y que él ha vivido en carne propia.

2),- Invitar a la gente a que se solidaricen con el compañero ayudando de muchas formas;

- ya sea económicamente para recaudar el dinero que se necesitara para el pago de la fianza, la multa y los tramites burocráticos que representa dicha prelibertad.

- con el envió de correos o cartas que sirvan para mantener comunicación con el compañero y alentar el ánimo y que sepa que no se le ha olvidado de este lado de las rejas.

- También para los compañeros que viven cercano a el DF o Estado de Mexico pueden colaborar con la donación de material que necesita para trabajar dentro del Reclusorio (resistol blanco, puntillas para pirógrafo, resina, seguetas finas).

- artículos de aseo personal como: jabón neutro, papel higiénico o pasta de dientes.

- tarjetas para hacer llamadas por teléfono (ladatel).

La cantidad que aproximadamente se necesitaría para agilizar la prelibertad (nos faltaría confirmar esto con una afianzadora) es de $50,000 (cincuenta mil pesos) antes del 15 de diciembre del 2007. En caso de no lograr reunir esa cantidad, se tramitaría el proceso normal de preliberación (sin pago de fianza) el cual es mucho más lento.

Por lo cual proponemos que en caso de no juntar el dinero que se le llegará a solicitar a la familia, lo recaudado sea destinado; una parte para cuando el compañero logrará su prelibertad para satisfacer su necesidades básicas de alimentación y vestido mientras se estabiliza económicamente después de padecer una injusta encarcelación, otra será destinada para casos de otros compañeras y compañeros presos.

Hasta el momento ya se ha entregado a las autoridades correspondientes:- la solicitud por escrito de su prelibertad:

- la presentación de los documentos de los tutores, los cuales han quedado dos compañeros que desinteresadamente han venido apoyando al compañero Carlos.

- La ubicación del lugar donde vivirá cuando logré su prelibertad.- Una ofertad de trabajo en la cafetería del Comité Cerezo.

Sobre la campaña:

- El envió de la campaña desde el correo de Carlos, como ficha de la lista de presos “Vientos de Libertad”.

- El re-envió masivo desde diferentes correo a las redes y organizaciones libertarias

- Se ha venido planteando la coordinación con las diferentes Cruz Negras Anarquistas y grupos e individuos solidarios tanto de Estados Unidos, Venezuela, España y México para la realización de conciertos o actividades a beneficio, que buscan recaudar parte de la ayuda económica. (ya que la solidaridad que despertó el caso del compañero difundido por diferentes medios por la Cruz Negra Anarquista de Venezuela y de Estados unidos ha tenido muy buen eco en diferentes partes, por lo cual ya se han confirmado algunos conciertos en solidaridad)

- Y la creación de este blog para informar sobre el proceso jurídico del compañero Carlos Skin, las actividades en solidaridad que se realicen, dar cuenta de de los apoyos económicos para su caso, y todas las iniciativas relacionadas con su caso.

Por último decirles que nuestro compañero Carlos, a pesar de las injusticias que ha padecido, a sus posibilidades continúa resistiendo, de ante mano agradece su interés y solidaridad que a su persona han demostrado en estos largos 6 años 6 meses de haber sido secuestrado por el gobierno mexicano.

Unfairly imprisoned more than 6 years ago

Kind of crimes attributed to him: Common law code

Crimes: Qualified theft

Sentence: 12 years and 6 months imprisoned, (with a $6,000 fine).

Human rights’ infringements committed against him.

-Torture and inhuman and debased ill

-treatment.

-Arbitrary arrest

-Abuse of authority

-Infringement of his right to a fair trial

ACTUAL SITUATION (October 2007)
According to the 76th decree, which grants the person sentenced the possibility to manage his preliberation by means of a bail and liquidation of the fine fixed by the judge, if the imprisoned has kept good behavior and attended the different rehab areas inside the prison, a new scenario can be drafted in which Carlos can be freed in December.

When knowing this, Carlos invites at first to the people who visit him in prison to look for the way of handling again his preliberation, which months ago was denied, together with his family (as they don’t have enough money to do it by themselves). A new campaign with two main goals begins:

1),- Broadcast the situation of this imprisoned mate (way we was arrested, the law process and ways of obtaining his prompt freedom), reporting the false justice, the abuse of authority and humans right outrage that is taking place in Mexico since a long time ago and that Carlos has suffered on his own body.

2), - Invite the people to declare their solidarity with our mate, helping in many ways:
- Either economically to collect the money necessary to pay the bail, the fine and the bureaucracy that represents the so-called preliberation.
- sending e-mails or letters to get in touch with Carlos and encourage him, letting him know that he hasn’t been forgotten on this side of the bars.
- Also for the people living near Mexico City or the State of Mexico, they can help by donating material he needs to work inside Prison (white gum, resin, etc.)
- Personal toilet articles, such as: soap, toilet paper or toothpaste.
- Phone cards (ladatel).

The amount of money needed approximately for his preliberation to be quicker (we have t corroborate this with a security agent) is of $50.000 (fifty thousand pesos) before the 15th November 2007. If we can’t manage to gather this amount, we would handle the normal preliberation process (with no bail), which is much slower.

For that reason we propose that, if we can’t get all the money together, the amount collected will be distributed as follows: a part of it for the basic nourishment and dressing needs of Carlos when he gets out of prison until he establishes economically after an unfair imprisonment, and another part to be assigned for the situation of other imprisoned mates.

For the moment, the corresponding authorities have received:
- A written application for his preliberation
- The documentation of the guardians, both of them mates who, with no other interest, have been supporting Carlos.
- The location of the place where he would live when he reaches his preliberation
- A job offer at the Comité Cerezo’s Café.

About the campaign:
- The sending of the campaign from Carlos’ email, as a file of the prisoners list “Vientos de Libertad”.
- The massive sending from different addresses to the libertarian nets and organizations
- It has been proposed the coordination between the different Anarchist Black Crosses and groups and individuals from the US, Venezuela, Spain and Mexico to organize concerts or activities in benefit of this case, which can collect part of the economic help. (Taking into account that the solidarity arose by the case of Carlos broadcasted by the Black Cross in Venezuela and the US has been well accepted in many places, and some solidarity concerts have been confirmed)
- The creation of this blog to inform about the law process of Carlos Skin, the solidarity activities done, the economic support and every initiative related to the case.

At last, we would like to say that Carlos, in spite of all the injustice he had suffered, he continues resisting against this unfair system, and thanks you all for your interest and solidarity during this long 6 years and 6 months of being kidnapped by the Mexican government.

HISTORIA DE SU DETENCIÓN

El día 14 de mayo de 2001 iba caminando rumbo al trabajo; eran las 12:55 ya que estaba el trabajo muy cerca de mi casa, cuando soy detenido por judiciales, que me acusan de haber supuestamente cometido un robo. Al negar todo lo anterior soy subido a la patrulla donde me empiezan a intimidar sicológicamente y con golpes me trasladan a la PGJ, lugar donde continuaron los interrogatorios, en los cuales, al negar las acusaciones, me comenzaron a golpear, me dijeron que mis delitos eran graves y que tenía que ser trasladado al CE.RE.SO, donde fui procesado por los siguientes delitos: robo a casa habitación, portación de arma, intento de secuestro, intento de violación y lesiones, los cuales, al avanzar el proceso fueron cayendo por falta de pruebas y de coherencia en la denuncia hecha en mi contra, ya que la parte acusadora no podía demostrar las acusaciones que se hacían a mi persona.

En el proceso el señor que me denuncia dijo que nos metimos en su casa, supuestamente éramos 3 sujetos que lo envolvimos en una cobija y que la cobija estaba rota y que por un agujero me vio los pies y por eso me reconoce, la hija dice que con una mano le amago la boca, con la otra le agarro los pechos y con la “OTRA” mano le pasaba la pistola en la vagina, la muchacha estaba embarazada porque ya se alivió, pero en ese momento pienso que por el susto hubiera abortado, el esposo de la hija en su versión de ella dice que lo habíamos picado y la esposa declara que el esposo no estaba y supuestamente mis cómplices nunca dicen qué hicieron, ahí es cuando yo pienso que supuestamente yo hago todo, se dice en el acta que se robó desde teléfonos celulares, aparatos electrodomésticos, alhajas y objetos de valor, así como dinero en efectivo.
Soy sentenciado por el Juez del 2° juzgado del foro común, a 15 años de prisión y 6 meses, la reparación del daño y una multa de aproximadamente 6 mil pesos, el día que me sentenciaron le hablo a mi familia para comunicar la mala noticia que ya había sido sentenciado, y mi hermana me comenta que una persona había ido a platicar con mi mamá y que le había comentado que el monto de lo robado no excedía los 10 mil peso y que con 5 mil podría ayudarme, mi mamá se confía de esta mujer y le da el dinero y ya después yo hablé, me dicen lo antes dicho pues me robaron el dinero, ya al día siguiente de visita mi madre lloró, ya que quería verme en la calle fuera de este lugar.

Ante esto se pone una apelación en contra de la sentencia, la cual después de algunos meses logra tener beneficios en mi persona, ya que se reduce la sentencia a 12 años 6 meses de prisión y una multa de aproximadamente 6 mil pesos. Inmediatamente se vuelve a interponer un amparo (esta vez directo) que no logra tener ningún beneficio y quedo con la misma sentencia.

A todo esto te preguntarás por qué no se pudo demostrar mi inocencia ya que al ser tan incoherentes las declaraciones y la falta de pruebas que me acusaran, por qué no estoy en libertad. Pues verás, en este sistema en el que vivimos, existen personas que estudian leyes sólo con la intención de conseguir un buen estatus social y dinero, perdiendo todo el sentido por el cual estudiaron, lo que quiero decir es que la mayoría de l@s abogados sólo les interesa sacarte dinero y no les importa demostrar tu inocencia y que te puedas pudrir en la cárcel. El primer abogado que tuve no hizo más que sacarle dinero a mi familia, aprovechándose de la falta de conocimiento en leyes y la desesperación de mi familia y amig@s en merme libre. El segundo sólo cobraba pero en realidad no realizaba nada en mi favor dejando mi asunto en el abogado de oficio, que paga el gobierno y es parte de la misma institución que me acusa, que en realidad sólo es creada para hundir en la cárcel a los pobres. Un tercero nunca pudo realizar algo más allá de sólo reducir mi condena, ya que los anteriores habían agotado mis recursos jurídicos, y a éste último le dejaban un caso lleno de negligencias en mi contra.

Hasta el momento llevo 5 años prisionero ilegalmente, por aquellos que dicen defender la justicia y la verdad, pero que en realidad se sustentan en la avaricia y la injusticia. Yo sé que soy inocente y que sólo mi aspecto fue un gran motivo de mi detención, ya que a la sociedad le han inculcado que vestir diferente es algo malo, y si lo haces ya eres un delincuente. En estos momentos estoy esperando que un nuevo abogado realice un diagnóstico jurídico de mi situación, para ver lo que se puede hacer en mi favor, ya que los anteriores abogados que tuve me perjudicaron mucho. Por lo cual algunos compañer@s desde afuera están llevando a cabo todo esto (no saben cuánto se lo agradezco) y me siento muy positivo en que pueda lograr mi libertad.

En todo el proceso mi familia siempre estuvo, al igual que Adriana, mi compañera, y muchos de ustedes que me apoyaron en el proceso como hasta la actualidad...mil gracias.

CARLOS ALBERTO ESTRADA, ANARCHIST UNFAIRLY IMPRISIONED MORE THAN FIVE YEARS AGO.

On 14th May 2001 I was walking to work at 12.55, thus my workplace is very near my home, when I was detained by the police, accused of having supposedly committed a robbery. When I deny the allegation, they introduce me in the patrol car and started intimidating physically and psychologically to me. They carried me to the PGJ, where they continue enquiring me, and when I deny the charges they started hitting me. I was told that I had committed extreme infringements and that I had to be moved to the CE.RE.SO. (Social Readaptation Centre), where I was prosecuted for the following charges: robbery in a living module, carrying of gun, kidnapping tentative and rape tentative. During the trial, none of these charges could be maintained because of lack of evidences and coherence in the demand against me, as the party accusing me couldn’t prove the accusations made against me.

During the trial, the man that accuses me said that three individuals got into his house, trapped him with a blanket that had a hole on it (that’s how he said he saw my feet and recognized me); her daughter said that I covered her mouth with one hand, with another hand I hold her breast and with “ANOTHER” one I passed the gun through her vagina. The young woman was pregnant at that moment (now she already has a child) and in my opinion this situation could have lead to an miscarriage. The daughter’s husband said that we pricked him, but the daughter said that her husband wasn’t at home. The two guys that were supposedly with me never appeared, and there’s where I start thinking it’s only me who did everything. On the record it is said that mobile phones, electrical appliances, jewels and other valuable objects were stolen.
I’m condemned to 15 years and 6 months in prison, and a penalty of approximately 6.000 pesos. The day I’m told the sentence I phoned my family to tell them the bad news and my sister tells me that someone had spoken to my mother to offer her help: the stolen amount wasn’t higher than 10.000 pesos, and if we paid her 5.000 she could help me out. My mother trusted this woman and gave her the money, but then she did nothing to help me, so she had stolen the money. During the next visit my mom cried, she wanted me out of this place.

We appealed the sentence and after a few months the appeal favours me, as the sentence is reduced to 12 years and 6 months in prison and a penalty of 6.000 pesos. Immediately we asked for an appeal for legal protection (this time directly) that obtains no benefit and I stay with the same sentence.

At this point you will be wondering why my innocence couldn’t be proved, why if the inconsistency of the declarations and the lack of evidences are so heavy I’m not set free. Well, on this system we are living there are people who study law just to acquire money and a high social status, forgetting the reason why they studied. What I want to say is that most lawyers are only interested in having your money and not in proving your innocence; they don’t care if you have to stay for long in prison. My first lawyer just dedicated himself to ask my family for money, profiting they hadn’t got a clue of laws and the despair of my family and friends to see me free. The second one only received his wage and did nothing on my favour, leaving my case to the legal aid lawyer, paid by the government, who’s part of the same institution that accuses me and that’s only created to leave in jail the poor people. A third one could only reduce my sentence, because the other two had used up all my legal resources and what he found was a case full of negligence against me.

I have been illegally imprisoned for five years now, by those who pretend to defend justice and truth, but who really are based on meanness and injustice. I know I’m innocent and that my external appearance was a big cause for my arrest, as in this society dressing on a different way is very bad seen, and if you do so, you are considered a criminal. Now I’m waiting for a new lawyer who can check my legal situation , just to see what can be done on my favour, as the other lawyers had worsen it. Some of my mates outside are in charge of everything (I’m very grateful for that) and I feel really positive to gain my freedom this time. During the whole trial my family has always been there, as well as Adriana, my girlfriend, and most of you, who had supported me during the procedure until today. Thanks a lot for that.

Situación jurídica 2006

Estas son algunas de las arbitrariedades durante la detención y el proceso;
a) Los hechos ocurrieron el día 7 de abril y lo detienen un mes después de lo ocurrido, el 14 de mayo del 2001.
b) Los judiciales que lo detienen, es sin previa orden de aprensión, siendo que declaraba la parte acusadora que conocía el domicilio y el nombre, ya que eran vecinos. ¿entonces por que no fueron inmediatamente a detenerlo a su domicilio y no esperarse un mes después?
c) La parte acusadora, menciona que lo reconoce por tener el pelo largo, cuando el compañero llevaba ya varios años de usarlo corto.
d) No existe pleno reconocimiento de que el haya sido el que robo, por parte de los que lo acusan y nunca se menciona que es en lo que participaron las demás personas, que supuestamente les robaron, ya que dicen que eran tres.
e) Las facturas presentadas de las supuestas cosas robadas, carecen de validez jurídica, ya que presentan la misma caligrafía (muy parecida a la de la hija del señor que lo acuso) además que al confirmar el domicilio de una de las facturas, no existen tal comercio.
f) Cuando declara la parte acusadora, que mientras Carlos amagaba a el señor, al mismo tiempo tenia a su hija en la cama y con una mano le pasaba la pistola en sus partes intimas, argumento que carece de validez, ya que para hacer esa maniobra , se tendría que tener mas de dos manos.
g) El día del supuesto robo, Carlos se encontraba en un centro social, al sur de la ciudad, como a 4 horas de distancia del lugar de los hechos. Para confirmar esta versión se presentaron testigos con los que el estuvo en dicho lugar, para ratificar la declaración de Carlos, además de un profesor que estuvo con ellos ese mismo día.
h) Cuando es detenido le “siembran” una navaja los judiciales, la cual es presentada como una de las pruebas en contra de Carlos.

Con todo esto se demostraba su inocencia y se le tenía que dar su completa libertad, pero el ministerio público no podía aceptarlo, ya que al dejarlo en libertad, Carlos podría demostrar el abuso policial y las vejaciones por parte de las diferentes dependencias policiales y judiciales, que fueron cometidas a su persona. Por lo cual se les podría demandar, por abuso de autoridad y negligencia judicial. Aunado a todo esto la falta de ética jurídica por parte de los diferentes abogados que supuestamente decían defenderlo.

Después de consultar a diferentes abogados sobre la situación jurídica actual de Carlos y la posibilidad de demostrar su inocencia, nos han comentado dos cosas muy importantes;
1) que los anteriores abogados agotaron todas las instancias jurídicas, que podrían demostrar su inocencia de Carlos,
2) que lo único que queda por hacer es solicitar la preliberación ante el juez ejecutor.

Dicha preliberación consiste en que se le otorgaría la libertad condicional, con la condición de que el preso guarde un buen comportamiento ante la sociedad, y acuda a las firmas periódicas dictadas por el juez, además de acudir a diferentes platicas durante el tiempo que resta se su sentencia, solo esta se puede solicitar una solo vez y en caso de ser negada, no se podría interponerse nuevamente.

Los requisitos que piden son los siguientes; que Carlos haya mantenido un comportamiento adecuado durante su estancia en el reclusorio, y haber cumplido con las diferentes áreas de rehabilitación, que son; laboral, custodia, medicina, psicología, educativa, trabajo social y psiquiátrico. Los cuales cada unos de los encargados de cada área, tiene que dar un informe positivo sobre la conducta y rehabilitación de Carlos, para después ser revisado por el juez y este conceder o negar dicha preliberación. En caso de que algún encargado de alguna área no conceda un diagnostico positivo, se negaría automáticamente la preliberación.

También tiene que haber un tutor que firme y se haga cargo de Carlos cuando este logre su preliberación y salga de la cárcel y durante lo que resta de la sentencia, dándole un lugar donde vivir y haberle conseguido un trabajo para cuando este en libertad y se incorpore en la sociedad. Lo cual será verificado por una trabajadora social e instancias del juzgado del reclusorio.

Ante este nuevo escenario nos hemos coordinado con la familia de Carlos para acompañar y ayudarlos económicamente en esta petición de la preliberación quedando como tarea dos cosas;
1) platicar con Carlos, decirle sobre estos requisitos y sobre las diferentes áreas que deberá cubrir, en caso de no haberlo hecho y elaborar el documento de la preliberación, 2) solicitar la ayuda económica, para los gastos que se presenten en el momento de la preliberación (en caso de ser aceptada la preliberación, Carlos tendría que ir a firmar periódicamente, tener un lugar donde vivir, por lo cual también se ocuparía dinero para la renta de una casa, ya que no podría regresar a el lugar donde vivía anteriormente).

Some of the arbitrary actions done during the arrest and the trial are:
a) The facts happened on the 7th April 2001 and he’s caught one month later, on the 14th May 2001.
b) The police arrested him without any arrest warrant even when the man accusing him said that he knew where he lived and his name, because they are neighbours. Then, why didn’t they go immediately to his house to arrest him but waited one month?
c) They said they recognized him because he had long hair, but Carlos has been wearing short hair for a long time.
d) There is no complete assurance from the party accusing that it was him who committed the robbery, and it’s never said how the others participated in the crime, as they supposedly said there where three of them.
e) When they present the bills of the supposedly stolen objects, these are not considered, because they are all written by the same person (with a very similar handwriting to the daughter of the man that accuses me) and in one of them the address of the shop doesn’t correspond with any actual business.
f) When it’s said that while he was assaulting the man, at the same time he had her daughter over the bed, and with one hand he passed the gun trough her vagina, argument without validity, thus to make such thing he should have more than two hands.
g) The day when everything happened he was at a social centre in the south of town, more than four hours away from the place of the robbery. We presented the declaration of two friends and a teacher that were with me to ratify this version.
h) When he’s arrested, the two policemen introduce him a knife, which is after presented as evidence against Carlos.

All these facts proved his innocence, therefore he had to be freed, but the Ministry of Public

Affairs couldn’t accept so, as if they set me free I could prove the police abuses and vexations made by the different police and judicial departments and I could sue them, altogether with the lack of ethics of the lawyers who said to defend him.

After having asked several lawyers about the actual legal situation of Carlos and the chances to prove his innocence, we have been told two very important things:
1) That the former lawyers had exhausted any legal instances that could prove Carlos’ innocence.
2) That the only thing that can be done is to ask for the pre-release before the judge.

This pre-release consists on parole, under the condition than the prisoner keeps a good behaviour before society and goes periodically to sign before the judge, and also that he assists to different speeches in the time he stays still in prison. The fact is that this pre-release can only be asked for once, and if denied, it could never be asked for again.

What they ask to be fulfilled is as follows: Carlos should have had a good behaviour during his imprisonment and fulfilled the different rehab areas, that is, working area, custody, medical, psychological, educative, social work and psychiatric. The person in charge of each area must give a positive diagnosis about Carlos’ behaviour and rehab, so that the judge can review it and approve or deny this pre-release. In case that one of the diagnosis was negative, the pre-release would be automatically denied.

There must be also a legal tutor who signs and gets in charge of Carlos when he reaches his pre-release and gets out of prison for the rest of the sentence, having therefore a place to live and a job for when he’s freed. A social worker will check that all these conditions are fulfilled.

Before this new scenario we have talked with Carlos’ family to accompany and support them economically during this petition, so what we have to do now is:
1) To talk with Carlos about all these conditions for his pre-release, so that he can fulfil them if he hasn’t done it already and write the pre-release document.
2) To ask for economical support for the expenses generated at the pre-release (if it’s accepted, Carlos would have to go and sign periodically, have a place to live, so money should be needed to rent a house, as he could not be back to the place where he lived before).
